I am trying (with little success) to change the current shifts we work in my dept.

A late shift currently finishes at 22.00, and if i work an early shift the next day i start at 07.00, giving me a nine hour break in between.

Is this legal? If not, what infor do i need to make my claim.

Any advice/help would be usefull.

your local council should be able to help, or if there is a union where you work a rep will know. Other than that I think it is legal. Sorry but good luck, or a job move??

I doubt these type of shifts are illegal, used to work them often myself and was "on-call" during the night as well which we got paid for but not for the hours worked if we had to get up in the middle of the night.

The only point of discussion is if these types of shift patterns were made clear to you when you took the job in the first place.

Just heading home, but if you check out the DTI website (dti.gov.uk), you will find all the information on shifts, breaks etc.

probbably legal
under the EWTD, junior docs can work 16 hour shifts, but then have to have 13 hours off
if your shift is less than this, then it probably complies

According to the Working Time directive (1998), an adult worker is entitled to no less than 11hrs rest in each 24 hrs.

be careful though
if some of the girls find it more conveneient to do 3 long days because of childcare, then the hours on the feet argument might snooker them
